Kohler New Zealand Warranty
LIMITED WARRANTY - AUSTRALIA
Kohler Co. (Kohler) warrants that Kohler plumbing fixtures and fittings are warranted free of manufacturing defects for the following set periods from the date of purchase on the terms set out below (Warranty):
Where the Kohler product is purchased for the purposes of a business or use at commercial premises, then the warranty period is 12 months from the date of installation of the product.

Where the Kohler product is purchased for the purposes of a business or use at commercial premises, then the warranty period is 12 months from the date of installation of the product.
Kohler specifies that in line water filters should be used with Kohler Tapware and that any damage to ceramic cartridges without the use of in line filters will void any Kohler warranty.
Kohler specifies that no cleaners should be used in any Kohler toilet cisterns and that any such use will void any Kohler warranty.
Kohler specifies that no chemicals such as bleach, hair dye, solvents, alcohols, citrus based chemicals, bath oils, bath salts and abrasive cleaners should be used in any Kohler bathing or showering product and that any such use will void any Kohler warranty. Also Kohler specifies that hot water must be limited to a maximum of 55 deg C and that any increase in temperature will void any Kohler Warranty.
Kohler will at its election, pursuant to its obligations under the Warranty:
- repair or replace the defective Kohler products or parts;
- pay the cost of repairing the defective products or parts;
- refund the purchase price to the purchaser; or
- make appropriate adjustment,
where Kohler's inspection discloses manufacturing defects subject to the terms and conditions stated below:
- The Warranty applies only within Australia and only to the original purchaser.
- The following will be not be covered by the Warranty:
- Damage due to accident, improper installation or handling, improper care and cleaning, faulty repairs, alteration, abuse or misuse (whether undertaken by a contractor, service company, or the customer);
- Kohler products installed, maintained or used other than in accordance with the instructions furnished by Kohler; and
- Cistern washers or rubbers.
The purchaser shall be responsible for and shall meet all charges in respect of making the defective product available for repair or replacement and any labour, transportation, travelling or communication expenses incurred.
Standard products may contain manufacturing imperfections of a minor character.
The Warranty is in addition to any warranties or conditions (if any) implied by the Trade Practices Act 1974 (Cth) or any other legislation in Australia which cannot be lawfully excluded. All other warranties and conditions whether , express or implied, including but not limited to warranties relating to the state, quality or condition of the products are excluded. Except to the extent set out in this document, Kohler disclaims any liability to any person for any loss or damage consequential or otherwise suffered or incurred by that person including without limitation any loss or damage caused by or resulting directly or indirectly from any failure, defect or deficiency of any kind of or in the products or any advice, recommendations or services. Kohler New Zealand Ltd will at its election, pursuant to its obligations under the Warranty, repair, replace or make appropriate adjustment where Kohler New Zealand Ltd's inspection discloses defects occurring in normal usage subject to the terms and conditions stated below:
- The Warranty applies only within New Zealand and only to the original purchaser;

The following will be not be covered by the Warranty:
- Damage due to accident, improper installation or handling, improper care and cleaning, faulty repairs, alteration, abuse or misuse (whether undertaken by a contractor, service company, or the consumer);
- Installed, maintained or used other than in accordance with the instructions furnished by Kohler New Zealand Ltd; and
- Cistern washers or rubbers;
The purchaser shall be responsible for and shall meet all charges in respect of making the defective product accessible for repair or replacement and any labour, transportation, travelling or communication expenses incurred;
Standard products may contain unavoidable manufacturing imperfections of a minor character; and
If a manufacturing defect is found, Kohler New Zealand Ltd will, as its election, refund the purchaser with the purchase price of the product or repair, provide a replacement part or product, or make an appropriate adjustment.
Apart from the provisions of the Consumer Guarantees Act 1993 (which will apply in addition to the Warranty), the Warranty is in lieu of all other warranties, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. Kohler New Zealand Ltd also disclaims any liability for special, incidental or consequential damages.
If the Kohler product is purchased for the purposes of a business, then all of the guarantees and remedies in the Consumer Guarantees Act 1993 are excluded and the Warranty periods and all other terms of the Warranty (as provided above) prevail.
